Welcome to Filvyn. Please read these Terms and Conditions (“Terms”, “Agreement”) carefully before using our website or purchasing any products. By accessing our site or placing an order, you agree to be bound by these legal terms. If you do not agree, please do not use our services.

1. Overview & Independent Print-on-Demand Fulfillment Model

  • Custom Production Flow: Filvyn Ventures operates as an independent design brand using decentralized, automated third-party manufacturing networks located within the United States.
  • No Pre-made Stock: Products are manufactured on an individual basis only after a customer’s payment is fully processed. Items do not exist in a pre-made inventory status.
  • Binding Agreement: By checking the terms agreement box at checkout, you explicitly acknowledge that you have read, understood, and agreed to both these Terms and our specific 7-Day Unboxing Video Return & Refund Policy.

2. User Account Eligibility & International Compliance

  • Age Threshold: You must be at least 18 years old, or the legal age of majority in your specific country of residence, to make purchases on this site.
  • Sanctioned Regions: By interacting with this platform, you warrant that you are not a resident of a country currently subject to international trade embargoes or financial sanctions.

3. Orders, Pricing, and Payments

  • Right of Refusal: We reserve the unconditional right to refuse, limit, or cancel any order at any time for reasons including product unavailability, systemic pricing errors, or transactions flagged by automated fraud prevention systems.
  • Pricing Currency: All prices displayed on Filvyn.com are denominated strictly in United States Dollars (USD).
  • Payment Processor Gateway: Payments are securely processed via Stripe. By submitting your payment card details, you authorize Stripe to charge the specified amount and agree to comply with Stripe’s Consumer Services Agreement.

4. Shipping, Carrier Liability, and Localized Delivery

  • Address Accuracy Obligation: The buyer bears sole responsibility for providing a complete, accurate, and valid US postal shipping address at checkout. We cannot modify shipping destinations after production begins.
  • Transfer of Title & Risk: Once a customized item is handed over to a domestic United States shipping carrier (including USPS, UPS, FedEx, or DHL), legal title and risk of loss pass entirely to the buyer. Filvyn Ventures is not responsible for transit delays, localized weather disruptions, or stolen mail (“porch piracy”) once tracking reads “Delivered.”
  • Abandoned Cargo: Shipments returned to our localized production partners due to an incorrect address, missing apartment numbers, or failure to collect from a local post office will be permanently classified as abandoned and are completely ineligible for a refund or free replication.

5. Final Sale & No Buyer’s Remorse

  • Customized Goods Exclusion: Because every item is manufactured dynamically to order, all sales are final.
  • Lock-In Window: Once an order enters our automated production loop (typically within 60 minutes of payment confirmation), it cannot be canceled, edited, or modified.
  • Exchanges Excluded: We do not offer refunds, product exchanges, or store credits for customer selection errors, including but not limited to:
    • Selection of incorrect garment sizes or fits.
    • Selection of incorrect color variants or custom graphic mockups.
    • General buyer’s remorse, aesthetic changes of mind, or late delivery within reasonable carrier windows.

6. Intellectual Property & Brand Protection

  • Proprietary Content: All custom artwork, text, store graphics, logos, website layout designs, and source code displayed on Filvyn.com are the exclusive intellectual property of Radha Krishna Kotha M/s Filvyn Ventures and are protected by international copyright laws.
  • Enforcement: You are strictly prohibited from scraping, reproducing, copying, or distributing any graphic assets from this website for commercial printing or competing dropship activities without explicit written consent.

7. Fraudulent Chargebacks and Mandatory Dispute Protocol

  • Pre-Arbitration Contact: Before filing a formal payment dispute, chargeback request, or claim with Stripe, your banking institution, or your credit card issuer, you agree to submit a support ticket to Filvyn Ventures directly and allow 5 business days for a manual resolution.
  • Evidence Submission: If you bypass this protocol and file a fraudulent “Item Not Received” or “Unrecognized Transaction” chargeback despite successful delivery, Filvyn Ventures will submit this signed digital agreement, your tracking log, IP address checkout logs, and carrier GPS delivery confirmations to Stripe and your financial institution as binding legal proof that you waived your refund rights.
  • Recovery of Costs: We reserve the right to report clear credit card fraud to your local United States postal inspection service or law enforcement authorities.

8. Limitation of Liability & Warranty Disclaimer

  • As-Is Framework: Filvyn Ventures provides this website, storefront portal, and its digital configurations on an “as-is” and “as-available” basis without any warranties, express or implied.
  • Liability Cap: To the maximum extent permitted by applicable laws, the total cumulative liability of Filvyn Ventures to you for any single claim arising out of a product purchase shall never exceed the exact dollar amount paid by you to us for that specific transaction.

9. Governing Law, Exclusive Jurisdiction, and Venue (Crucial)

  • Jurisdiction: This Agreement, your purchase transactions, and any legal disputes arising between you and Filvyn Ventures shall be governed by, construed, and enforced strictly in accordance with the laws of India, without regard to its conflict of law principles.
  • Exclusive Legal Venue: You explicitly agree that any formal legal suit, arbitration, or judicial proceeding arising out of your interaction with Filvyn.com or its products must be filed exclusively in the courts located within Bengaluru, Karnataka, India.
  • Waiver of Extraterritorial Venues: By placing an order, you completely waive any right to initiate legal proceedings against the owner of Filvyn Ventures within the courts of the United States or any other international jurisdiction.
